Terms & Conditions
1) Scope
1.1 Verisana GmbH, Spitalerstraße 9, 20095 Hamburg, operates a portal under the internet address www.verisana.de for laboratory services and nutritional products. These General Terms and Conditions (“GTC”) apply to all contracts concluded between Verisana GmbH (“Seller”) and consumers or entrepreneurs (“Customer”) for the purchase of goods and/or services offered in the online shop. The inclusion of the customer’s own terms and conditions is hereby rejected, unless expressly agreed otherwise.
1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity acting in the exercise of their trade or profession when concluding a legal transaction.
2) Conclusion of Contract
2.1 The product descriptions contained in the online shop do not represent binding offers, but serve to enable the customer to submit a binding offer.
2.2 The customer can submit an offer via the online order form. After placing the selected products in the shopping cart and completing the electronic order process, the customer submits a legally binding offer by clicking the button concluding the order process. Offers can also be made by telephone or email.
2.3 The seller may accept the customer’s offer within five days:
- by sending a written or electronic order confirmation,
- by delivering the goods, or
- by requesting payment from the customer.
If none of these occurs, the offer is deemed rejected after the period expires.
2.4 When selecting “PayPal Express”, payment processing occurs via PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg, under their applicable terms (view PayPal terms).
2.5 The contract text is stored and sent to the customer after ordering by email.
2.6 Before final submission, the customer can correct entries using standard keyboard and mouse functions.
2.7 The contract language is exclusively German.
2.8 The customer must ensure that the provided email address is correct and capable of receiving messages.
2.9 We do not sell to minors or other legally incapacitated persons without consent of their legal representative.
3) Right of Withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Detailed information can be found in the seller’s cancellation policy.
4) Prices and Payment Terms
4.1 All prices are total prices including statutory VAT. Shipping costs are shown separately.
4.2 For deliveries outside the EU, additional costs (e.g., transfer fees, customs duties) may apply.
4.3 Payment options are indicated in the online shop; all payments are made in EUR.
4.4 If prepayment is agreed, payment is due immediately after contract conclusion.
4.5 PayPal payments are subject to PayPal’s user terms (PayPal terms).
4.7 For PayPal Direct Debit, fees from failed withdrawals due to insufficient funds are borne by the customer if attributable to them.
5) Delivery and Shipping Terms
5.1 Delivery is made to the address provided by the customer unless otherwise agreed.
5.2 If delivery is unsuccessful and the goods are returned, the customer bears the costs unless they are not at fault.
5.3 Self-collection is possible; shipping costs do not apply.
5.4 Dispatch occurs on business days (Mon–Fri, 9:30–17:00) via Deutsche Post.
5.5 If delivery fails after three attempts, the seller may withdraw and refund the payment.
5.6 If an item is unavailable, the customer is informed and offered a refund or alternative.
6) Retention of Title
Goods remain the property of the seller until full payment is received.
7) Liability for Defects (Warranty)
7.1 The statutory warranty provisions apply.
7.2 For used goods, warranty claims expire one year after delivery, except in cases of fraud or injury to life, body, or health.
7.3 Customers are requested to report visible transport damage immediately. Failure to do so does not affect rights.
8) Redemption of Promotional Vouchers
8.1 Promotional vouchers can only be redeemed within the specified period in the online shop.
8.2 Certain products may be excluded.
8.3 No retrospective crediting possible.
8.4 Several vouchers may be used per order.
8.5 Remaining balances are not paid out.
8.6 If the order exceeds the voucher value, the balance can be paid by other methods.
8.7 No interest or cash payment for balances.
8.8 No refund of vouchers for returned goods.
8.9 Vouchers are transferable.
9) Liability
9.1 Internet data transmission cannot be guaranteed error-free or continuously available; we assume no liability for uninterrupted access.
9.2 Liability applies for intent and gross negligence. For slight negligence only when breaching essential contractual obligations.
9.3 Scientific information may change due to ongoing research.
9.4 Product and therapy information does not replace professional medical advice.
9.5 Test results are not diagnoses and should be discussed with your physician.
10) Patient Declaration
By clicking “Submit Order”, the customer agrees to the performance of the selected laboratory tests. These are preventive services that may not be covered by health insurance.
11) Applicable Law
German law applies, excluding UN sales law. For consumers, this applies only insofar as protection is not withdrawn by mandatory law of their residence country.
12) Jurisdiction
For merchants or legal entities under public law, exclusive jurisdiction is Hamburg, Germany.
13) Code of Conduct
The seller complies with the Trusted Shops Quality Criteria (view criteria).
14) Alternative Dispute Resolution
14.1 The EU Commission provides an online platform for dispute resolution at https://ec.europa.eu/consumers/odr.
14.2 The seller is neither obliged nor willing to participate in such procedures.
15) Further Information
15.1 Should any provision be invalid, the remainder of the contract remains effective.
